Agreement to these terms

These Terms and Conditions ("Terms") govern your use of cutkitchen.com (the "Site") and your purchase of products from it. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

The Site is operated by Cut Kitchen Foods Inc., 3996 Dumfries St., Vancouver, BC V5N 0J1, Canada ("Cut Kitchen", "we", "us"). You can reach us via the contact page. This is our business address, not our return address; contact us before mailing a return.

Products and food information

Our products are food. Product descriptions, nutrition figures, and preparation instructions on the Site are provided for general information and are based on the product label; in the event of any discrepancy, the information on the physical packaging governs. Always check the label and ingredient list before consuming, particularly if you have allergies or dietary restrictions. Our products contain rice flour and konjac. Prepare as directed on the package. Do not consume dry.

Content on this Site is not medical, nutritional, or health advice, and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Consult a qualified professional about your individual dietary needs.

Orders and payment

All orders are offers to purchase, which we may accept or decline (for example, where a product is unavailable or a listing contains an error). Payment is processed at checkout through our payment providers. We may cancel and refund any order at our discretion, including where we suspect fraud or resale abuse.

Pricing

Prices are in US dollars unless stated otherwise and exclude applicable taxes and shipping, which are calculated at checkout. We may change prices at any time; changes don't affect orders already placed. If a price is listed in error, we may cancel the affected order and refund you in full.

Shipping and delivery

Shipping areas, rates, and delivery estimates are described on the Shipping page, which forms part of these Terms. Delivery estimates are estimates, not guarantees. Risk in the products passes to you on delivery to your shipping address.

Returns and guarantee

Subscriptions

Monthly subscriptions renew automatically until cancelled. Renewal billing, cancelling, skipping, and price changes are described on the Subscriptions page, which forms part of these Terms.

Our collection, use, and disclosure of personal information are described in our Privacy Policy, which forms part of these Terms.

Promotional codes

Promotional codes are single-use per customer unless stated otherwise, can't be combined, have no cash value, and may be withdrawn at any time. We may cancel orders that misuse a code.

Intellectual property

The Site and everything on it — the Cut Kitchen name and logo, copy, photography, and design — belong to Cut Kitchen Foods Inc. or its licensors. You may not reproduce or use them commercially without our written permission.

Acceptable use

You agree not to misuse the Site: no unlawful use, no attempting to interfere with its operation or security, no scraping at scale, and no misrepresenting your identity when ordering or contacting us.

Disclaimer of warranties

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits any warranty or consumer right that cannot be limited under applicable law.

Limitation of liability

To the fullest extent permitted by law, Cut Kitchen's total liability for any claim arising from your use of the Site, or the purchase, preparation, handling, or consumption of our products, is limited to the amount you paid for the products giving rise to the claim, and we are not liable for indirect, incidental, or consequential losses. This limitation does not apply where liability cannot be limited under applicable law.

Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable in it. Any dispute will be resolved in the courts of British Columbia, unless applicable consumer law gives you the right to a different forum.

Changes to these terms

We may update these Terms from time to time; the version posted on the Site at the time of your order applies to that order. Material changes will be indicated by the "Last updated" date on this page.
